Terms of Service

1. Overview
GJ Smashers (the “Service”), operated at gjtrades.com, is a subscription-based software platform that provides market analysis, informational trade setups, and position-sizing guidance for educational purposes. By creating an account, subscribing, or otherwise using the Service, you agree to these Terms of Service (“Terms”). If you do not agree, do not use the Service.
2. Nature of the Service
GJ Smashers is a software platform. It is not a broker, dealer, investment advisor, financial advisor, commodity pool, commodity trading advisor, or introducing broker. Nothing provided through the Service constitutes financial advice, a recommendation to buy or sell any instrument, or a solicitation of any transaction.
Market analysis, setup identifications, position-sizing calculations, alerts, and any other output produced by the Service are informational and educational only. You are solely responsible for your own trading decisions and their consequences.
No content on the Service should be interpreted as a solicitation, offer, or recommendation to enter into any transaction involving financial instruments.
Use of the Service does not create any fiduciary, advisory, or agency relationship between you and GJ Smashers.
You make all trading decisions independently, and you are solely responsible for all outcomes resulting from those decisions.
3. No Guarantees
Past performance, backtest results, and hypothetical outcomes are not indicative of future results. No representation is made that any account will or is likely to achieve profits or losses similar to those shown. Market conditions change, and the Service’s analysis methods may perform differently at different times.
All outputs are generated using predefined algorithms and do not account for your individual financial situation, objectives, or risk tolerance.
Any simulated or backtested performance reflects hypothetical results and does not represent actual trading. Simulated results may not reflect the impact of real market conditions, including liquidity, slippage, or execution delays.
4. Eligibility
You must be at least 18 years old and legally able to enter into a contract in your jurisdiction. You are responsible for ensuring that your use of the Service complies with all applicable laws, including local rules on securities, derivatives, and financial services.
5. Accounts
You are responsible for safeguarding your credentials and for all activity that occurs under your account. Notify us immediately at support@gjtrades.com if you suspect unauthorized access. We may suspend or terminate accounts that violate these Terms, abuse the Service, or create risk for us or other users.
6. Subscriptions and Billing
The Service is offered on a recurring subscription basis. By subscribing, you authorize recurring charges to your payment method at the stated price and interval until you cancel. Prices are displayed at checkout and may change; any change will be communicated in advance and apply only to subsequent billing periods.
Payments are processed by Stripe, Inc. By paying, you also agree to Stripe’s terms and privacy policy. We do not store your full payment card details.
You are purchasing access to software functionality, not the purchase of any financial product, trade, or investment outcome.
7. Refunds and Cancellations
Our Refund Policy is incorporated into these Terms by reference. In summary: the Service is subscription-based and non-refundable once a billing period has begun; you may cancel at any time to stop future billing; discretionary refunds may be granted at our sole option.
Access to the Service constitutes delivery of the product. No physical goods are delivered.
8. Acceptable Use
You agree not to: (a) resell, redistribute, or sublicense outputs of the Service; (b) reverse-engineer, scrape, or attempt to extract proprietary methodology; (c) interfere with or disrupt the Service; (d) use the Service to violate any law or regulation; (e) represent outputs of the Service as financial advice to any third party.
9. Intellectual Property
The Service, including its software, content, analysis methodology, and branding, is owned by GJ Smashers and protected by applicable intellectual-property laws. We grant you a limited, revocable, non-transferable license to access and use the Service for personal, non-commercial purposes while your subscription is active.
10. Third-Party Services
The Service may integrate with third parties (Stripe for payments, Supabase for account storage, Resend for transactional email, Twilio for SMS, Discord for community channels, and similar providers). Their terms and privacy practices apply to the respective portions of your experience.
11. Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED AVAILABILITY. WE DO NOT WARRANT THAT ANY MARKET ANALYSIS, SETUP, OR ALERT WILL BE PROFITABLE OR ERROR-FREE.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GJ SMASHERS AND ITS OPERATORS, EMPLOYEES, AND CONTRACTORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR TRADING LOSSES, EVEN IF ADVISED OF THE POSSIBILITY. OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
13. Indemnification
You agree to indemnify and hold harmless GJ Smashers from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Service, your trading decisions, or your breach of these Terms.
14. Termination
You may stop using the Service at any time by canceling your subscription from the billing page or by contacting support. We may suspend or terminate your access for any reason, including violation of these Terms. Sections intended to survive termination (including disclaimers, limitation of liability, indemnification, and dispute resolution) continue to apply.
15. Governing Law; Dispute Resolution
These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-laws principles. Any dispute arising out of or relating to the Service or these Terms will be resolved exclusively in the state or federal courts located in Florida, and you consent to personal jurisdiction and venue there.
16. Changes
We may update these Terms from time to time. Material changes will be communicated via email or an in-app notice; continued use after the effective date constitutes acceptance. The current version is always available at /terms.
